1. About CLEWASE
CLEWASE provides sellers with tools to select products, upload designs, create and manage orders, and coordinate production and shipping.
Certain products may be produced and fulfilled by third-party manufacturing, printing, logistics, or fulfillment partners.
2. Seller Accounts
You must provide accurate and current information when creating your CLEWASE account.
You are responsible for maintaining the security of your account credentials and for all activity performed through your account.
You may not create accounts using false information, impersonate another person or business, or use CLEWASE for fraudulent or unlawful activities.
3. Seller Responsibility
Sellers are responsible for the products, designs, content, customer information, shipping information, and orders submitted through their accounts.
You are responsible for ensuring that information submitted for an order is complete and accurate before production begins.
4. Designs and Intellectual Property
You retain ownership of original designs and content that you upload to CLEWASE.
By uploading a design, you grant CLEWASE and its production partners a limited license to use, reproduce, print, manufacture, process, and transmit that design solely as necessary to provide the requested services.
You may only upload content that you own or have the legal right to use.
You may not upload content that infringes copyrights, trademarks, patents, privacy rights, publicity rights, or other intellectual property rights.
CLEWASE may remove or refuse designs or orders that appear to violate intellectual property rights, applicable laws, or platform policies.
5. Products and Product Information
We aim to present product descriptions, dimensions, materials, colors, and other specifications accurately. Minor variations may occur as a result of manufacturing, printing, screen settings, materials, or production processes.
6. Pricing
Seller pricing may be available only to registered and authorized CLEWASE users.
Prices may change from time to time due to production, material, shipping, currency, supplier, or operational costs.
The price displayed when an order is submitted will normally apply to that order unless a technical or pricing error has occurred.
All payments collected directly through CLEWASE are processed in U.S. dollars (USD), while international delivery destinations may remain available.
7. Orders
Once an order is submitted for production, changes or cancellations may not be possible.
Sellers are responsible for reviewing product selections, quantities, designs, variants, customer details, and shipping addresses before submitting an order.
8. Production and Shipping
Production and delivery estimates are provided as estimates and are not guaranteed delivery dates.
Delays may occur because of production capacity, suppliers, carriers, customs, weather, holidays, incorrect addresses, or circumstances outside our reasonable control.
Tracking information may be made available when provided by the applicable shipping carrier or fulfillment partner.
9. White Label Fulfillment
Where available, CLEWASE may provide white label fulfillment services that allow products to be shipped without prominent CLEWASE consumer-facing branding.
Specific packaging and fulfillment options may vary by product, supplier, and destination.
10. Returns, Refunds and Replacements
Returns, refunds, replacements, damaged products, printing defects, incorrect products, and shipping issues are governed by our Refund Policy.
11. Prohibited Uses
You may not use CLEWASE to:
- Commit fraud or other unlawful activities.
- Sell or distribute illegal products or content.
- Infringe intellectual property rights.
- Upload malicious software or harmful code.
- Attempt unauthorized access to CLEWASE systems.
- Abuse, disrupt, scrape, or overload the platform.
- Misrepresent your identity or business.
12. Account Suspension or Termination
CLEWASE may restrict, suspend, or terminate access to an account if we reasonably believe that the account is being used in violation of these Terms, applicable law, intellectual property rights, security requirements, or other CLEWASE policies.
13. Third-Party Services
CLEWASE may rely on third-party providers for services including payments, authentication, hosting, manufacturing, printing, shipping, email delivery, analytics, and infrastructure.
Availability of these services may occasionally affect CLEWASE functionality.
14. Service Availability
We aim to keep CLEWASE available and reliable, but we do not guarantee uninterrupted or error-free operation.
Features may be modified, temporarily unavailable, or discontinued where reasonably necessary.
15. Limitation of Liability
To the extent permitted by applicable law, CLEWASE will not be liable for indirect, incidental, special, consequential, or loss-of-profit damages arising from the use of the platform.
16. Legal Operator and Business Identity
CLEWASE is currently operated by Aydın Okan Polat as an individual operator based in Kayseri, Türkiye.
CLEWASE is the commercial and platform name used for the services described in these Terms. CLEWASE is not currently presented as a separate incorporated legal entity.
If the legal operating structure changes in the future, these Terms may be updated to reflect the applicable company name, registration details, tax information, and registered address.
17. Governing Law
These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer or other applicable law provides otherwise.
18. Jurisdiction and Disputes
Subject to any mandatory rights or jurisdiction rules that cannot legally be excluded, disputes arising out of or relating to these Terms, CLEWASE, or the services will be submitted to the competent courts and enforcement offices of Kayseri, Türkiye.
Before starting formal proceedings, the parties are encouraged to contact each other in good faith and attempt to resolve the dispute informally where appropriate.
19. Changes to These Terms
We may update these Terms from time to time. The updated version will be published on this page with a revised “Last updated” date.
Continued use of CLEWASE after an update constitutes acceptance of the revised Terms where permitted by applicable law.
